Guidezone Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Guidezone application (the “Service”). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By choosing to access or utilize the Service, you signify your agreement to abide by these Terms in full. If you find that you do not agree with any portion of these Terms, we kindly ask that you refrain from using the Service.

Scope of Services

The Service serves as a platform that allows users (“Members”) and third-party guides (“Guides”) to connect. Members can explore Guides' services (“Listings”) and communicate directly with Guides to book trips (“Bookings”). Guidezone AB facilitates the payment for Bookings and legally sells the service. Upon completion of a Booking, Members enter into a client relationship with the Guide, not with Guidezone AB. While Guidezone AB facilitates transactions/payments & communications, the Guide is solely responsible for delivering the services agreed upon in the Booking. By booking with Guidezone, you comply to these terms of services.

Communications

By creating an Account, you can choose to subscribe to newsletters and other promotional materials. You can opt out anytime by emailing our support or using the unsubscribe link in our emails.

Payments

For your convenience and security, all payments for Bookings made through the Service are processed via our trusted third-party payment partner, Stripe. By making a Booking through the Service, you agree to Stripe's terms and conditions.

Accounts

When creating an account, ensure your information is accurate and updated. You are responsible for maintaining your account security. Guidezone AB can terminate accounts or refuse service at its discretion.

Intellectual Property

All original content of the Service remains the property of Guidezone AB. Unauthorized use of our trademarks or content is prohibited.

Links to Other Websites

Our Service may link to third-party sites. Guidezone AB isn't responsible for the content or practices of these sites.

Termination

Guidezone AB may terminate or suspend access to users to the Service for any reason, including breaches of these Terms.

Limitation of Liability

Guidezone AB and its affiliates won't be liable for any indirect damages or losses arising from the use of or inability to use the Service.

Release of Liability

By using the Service, users agree not to sue Guidezone AB for any damages or losses they might incur. This includes any issues arising from Bookings or interactions with Guides.

Disclaimer

Guidezone AB assumes no responsibility for the tours conducted by the Guides, including but not limited to accidents, losses, or any other issues that might occur during the tour. Members are advised to refer to the Guides, along with local laws and rules for guiding and outdoor adventuring, for any questions or concerns related to safety and legal responsibilities. Guidezone conducts procedures in regard to the guide’s credentials upon (the guide) joining the service. However, it’s ultimately up to the Member to ensure the accuracy, reliability, completeness, or timeliness of any Guide’s credentials or certifications (such as IFMGA certification, for example). It is the Member’s responsibility to verify the Guide’s qualifications and determine their suitability for a given tour or adventure.

Cancellation and Refund Policy

We understand that plans can change, which is why we offer a cancellation policy with varying refund windows. The following outlines the refund you can expect should you decide to cancel your booking:

First 24 Hours After Booking: You will receive a 100% refund if you cancel within the first 24 hours after booking, minus any administration fees and Guide expenses incurred. Note: This does not apply if it's booked on short notice, which is defined by less than seven (7) days before the tour date.
30 Days or More Before Tour Date: If you cancel 30 days or more before your scheduled tour date, you will receive a 75% refund, minus any administration fees and Guide expenses incurred.
15 to 29 Days Before Tour Date: If you cancel between 14 and 29 days before your scheduled tour date, you will receive a 50% refund, minus any administration fees and Guide expenses incurred.
Less Than 15 Days Before Tour Date: If you cancel less than 14 days or less before your scheduled tour date, you are not eligible for a refund.

In a case where the guide cancels the trip due to personal reasons, either a substitute guide is found, and if not possible, a refund is processed.

Refunds can not be provided in the following situations:

If tourism services like lift facilities, rail services, hotels, or restaurants close due to weather conditions or natural events (e.g., official weather warnings). The guide will propose the most suitable activity in scenarios like these.
If the customer falls ill, has an accident, or for other reasons can't partake.
If the activity is started, but the objective can't be reached. For example: If a climb of a certain mountain, or a day of guided activity is started, but the main objective can't be completed - either due to the fitness or skill of the client, or due to weather. The guide always reserve the right to make the decision on this.

Recommendations

Accident Insurance

It's up to the Member and all individuals of the party to have their own insurance that covers accidents, evacuations, and other related costs (transport, hospital, etc.), in the event of an accident. We recommend checking with your personal insurance company to see what's covered and not, and specifically if it covers activities such as alpinism, mountaineering, climbing, and off-piste skiing, outside normal mountain resort boundaries. This is up to the individual (the guest / user) to have when going on a tour.

Cancellation insurance

It's recommended to have a cancellation insurance in case of a non-refundable cancellation (see more in our Cancellation and Refund Policy above).

Additional Terms

Dispute Resolution: In the event of a dispute between Members and Guidezone AB, users should first contact our customer service for resolution. This process may require mediation before any lawsuit can be filed.

Users are responsible for complying with local laws and regulations when using the Service.

Service Modifications: Guidezone AB reserves the right to modify or discontinue the Service at its sole discretion. Changes to the Service do not grant users the right for a refund or to hold Guidezone AB liable.

Exclusions: Certain jurisdictions do not permit the exclusion of particular warranties or the limitation of liability for consequential or incidental damages. Therefore, the aforementioned limitations might not be relevant in your jurisdiction.

Pictures: Guidezone have the right to post pictures taken on the tour on Social Media and in promotional purposes. If the User does not want this to happen, that is always accepted, but has to be communicated to Guidezone.

Miscellaneous Provisions: The Terms will be interpreted and governed by the laws of Sweden.
